Google Athlete & Google Business Profile Terms of Service

These Terms of Use (or "Terms") govern your use of Google Athlete, except where we expressly state that separate terms (and not these) apply, and provide information about the Google Athlete Service (the "Service"), outlined below. When you use Google Athlete, you agree to these Terms and Google Terms of Service.

These Terms of Use therefore constitute an agreement between you and Google Athlete.

To use Google Business Profile or any related services, features and functionality (the 'Google Business Profile Services'), you must accept (1) the Google Terms of Serviceand (2) these Business Profile Additional Terms of Service (the 'Google Business Profile Additional Terms').

Please read each of these documents carefully. Together, these documents are known as the 'Terms'. They establish what you can expect from us as you use Business Profile Services and what Google expect from you.

If these Google Business Profile Additional Terms conflict with the Google Terms of Service, these Business Profile Additional Terms will govern for Business Profile Services

What Google expect from you

You’re responsible for the entity listed on your profile (your 'Business Profile'). That means, in addition to following the basic rules of conduct in the Google Terms of Service, you must, when using the Business Profile Services:

  • Comply with applicable laws and industry best practices when operating and promoting your entity, including obtaining all applicable licences and approvals.
  • Ensure that your content is correct, up to date and complete
  • Supply all required disclaimers, warnings and notices (or if you rely on any supplied by Google, ensure their sufficiency for your entity).
  • Comply with these policies which apply to the Business Profile Services
Moderation of your content and other content on the Business Profile

Google is not responsible for your Business Profile or the entity listed on your profile. But, once your business is claimed understand that Google have the right, but not the obligation, to moderate the content that you provide using Business Profile Services. Google are constantly striving to ensure that information in your Business Profile is complete, relevant and up to date so that the business details displayed on Google are as useful as possible for you and our users. This means that, occasionally, Google may choose not to display your content (for example, if trusted signals indicate that your content is not accurate). Google may also choose to show an edited version of your content or content from an alternative source in place of your content.Learn more about how Google sources and displays information in Business Profiles .

Your access to your content

You’ll maintain access to your content in Business Profile Services in accordance with the functionality described here . You can at any time. Although it’s not a part of these Terms, Google encourage you to read at any time. Although it’s not a part of these Terms, Google encourage you to read Privacy Policy to better understand how you can update, manage, export and delete your information .

Google’s access to your account

If you authorise Google to do so, Google may access your account to help you manage your Business Profile and account.

Relationship

You must be the owner of the entity listed on your profile or an authorised representative able to bind others on behalf of that entity.

Binding others

You must bind any users who manage or later own your Business Profile to these terms before making them managers or owners.

Licence

This licence covers the basic Business Profile information about your entity that you provide, if that information is protected by intellectual property rights. You give Google a perpetual (which means for as long as that information is protected by intellectual property rights), irrevocable, worldwide, royalty-free and non-exclusive licence to reproduce, adapt, modify, translate, publish, publicly perform, publicly display, distribute and create derivative works of the basic Business Profile information about your entity that you provide (such as the entity name, location, phone number, category, hours and Google site). You also grant to other Google services users the right to access and use, including the right to edit, that information as permitted under the applicable Google Terms of Service.

All other content that you provide to your profile (such as business photos) is licensed to Google under the Google Terms of Service.

Other products and services

You may be provided access to other products and services within your account. These products and services may be subject to their own separate terms and policies that Google will make available to you.

Settle disputes

If you’re a business user based in the EU or the United Kingdom, you can also apply to resolve a dispute under these Terms with mediation. Except as required by applicable law, mediation is voluntary and neither you nor Google are obliged to settle disputes through mediation.

Take action in case of problems

Before moving to terminate the Terms, Google will give you no less than 30 days advance notice if required by applicable law.

Questions or complaints

If you have any questions or complaints regarding Google My Business Services, you can go to our Help Centre or you can contact us. If you believe that your access to Google My Business Services has been suspended or terminated in error, you can appeal.

Contract

You agree that by clicking “Get started”, or using our services (described below), you are agreeing to enter into a legally binding contract with Google Athlete/Nowlocal Inc. (even if you are using our Services on behalf of a company). If you do not agree to this contract (“Contract” or “User Agreement”), do not click “Get started” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services. (After the minimum 3 months agreement

Google Athlete

You are entering into this Contract with Google Athlete. (also referred to as “we” and “us” If you reside in the “Designated Countries”, you are entering into this Contract with Google Athlete. Google Athlete will be the controller of your personal data provided to, or collected by or for, or processed in connection with our Services.

Membership

Your Google Athlete membership will continue until terminated. To use the Google Athlete service you must provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorise us to charge the membership fee for the next billing cycle to your Payment Method (see "Cancellation" below).

We may offer a number of membership plans, including memberships offered by third parties in conjunction with the provision of their own products and services. Some membership plans may have differing conditions and limitations.

Promotional Offers

We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is determined by Google Athlete at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible.

Billing and Cancellation

The relationship fee for the Google Profile management service will be charged to your Payment Method on the specific payment date.

In order to use the, you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated with your account if your primary Payment Method is declined or no longer available.

If your payment fails to clear due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend our SEO until we are able to charge your Payment Method successfully.

You can cancel your Google Profile management service at any time, and you will continue to have access to our Google Profile management service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial or unused service periods. To cancel, please send an email to office@gooleathlete.com or alternatively you can cancel through your bank or Account Manager. It is Google Athlete's property to own any content, graphic, or work posted on your Google Business Profile. If you cancel your service, Google Athlete reserves the right to remove all SEO and content created on the Google Business Profile. Cancelling your service will automatically close your account with Google Athlete at the end of your current billing period.

We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.

Payment Methods.

To use the Google Athlete service you must provide one or more Payment Methods. You authorise us to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

Updating your Payment Methods

You can update your Payment Methods by contacting us. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorise us to continue to charge the applicable Payment Method(s).

Cancellation

YYou can cancel your Google Athlete membership at any time, and you will continue to have access to the Google Athlete service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused Google Athlete content. To cancel, go to www.googleathlete.com/, then contact us or contact your account manager. If you cancel your membership, your account will automatically close at the end of your current billing period. If you signed up for Google Athlete using your account with a third party as a Payment Method and wish to cancel your Google Athlete membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Google Athlete service through that third party. /p>

Change

We may make changes to the Contract.

We may modify this Contract, our Privacy Policy and our Cookies Policy from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you may by contacting us at www.googleathlete.com or emailing your account manager. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.

The Services are not for use by anyone under the age of 16.

To use the Services, you agree that: (1) you must be the "Minimum Age"(described below) or older; (2) you will only have one Google Athlete account, which must be in your real name; and (3) you are not already restricted by Google Athlete from using the Services. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 16.

“Minimum Age” means 16 years old. However, if law requires that you must be older in order for Google Athlete to lawfully provide the Services to you without parental consent (including using of your personal data) then the Minimum Age is such older age.

Sharing

Our Services allow sharing of information in many ways, such as your profile and reviews. Information and content that you share or post may be seen by other Google members.

Intellectual Property Rights

Google Athlete reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. Google Athlete, and “in” logos and other Google Athlete trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of Google Athlete.

Google Athlete is an independently owned and operated business. Google Partner, Google Logos are trademarks of Google Inc

Exclusion of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW (AND UNLESS GOOGLE ATHLETE HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT OVERRIDES THIS CONTRACT), GOOGLE ATHLETE, INCLUDING ITS AFFILIATES, WILL NOT BE LIABLE IN CONNECTION WITH THIS CONTRACT FOR LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, REPUTATION (E.G., OFFENSIVE OR DEFAMATORY STATEMENTS), LOSS OF DATA (E.G., DOWN TIME OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT) OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES.

Choice of Law and Jurisdiction

These Terms are governed in all respects by the laws of England & Wales without giving effect to any principles that may provide for the application of the law of another jurisdiction. You agree that any claim or dispute you may have against us must be resolved by a court located in England & Wales. You hereby submit to the personal jurisdiction of the courts located within England & Wales for the purpose of litigating all such claims or disputes. Any cause of action you may have with respect to this Site or Application must be commenced within 30 days after it arises, or the cause of action is barred.
